In these Terms and Conditions, "PinPark", "we", "us", or "our" refers to the PinPark mobile application and the PinPark website. These Terms and Conditions govern users' access to and use of the PinPark website. By accessing or using the app or website, users agree to be bound by these Terms and Conditions. If users do not agree with any part of these Terms, they should not use the PinPark application or website.

Our Privacy Policy explains how we collect, use, and protect users' personal data. By using the PinPark application or website, users also agree to our Privacy Policy, which forms part of these Terms and Conditions.

These Terms and Conditions apply to all users of the PinPark mobile application and the PinPark website.


1. Use of the Service

1.1 Overview
PinPark provides a location-based parking assistance service designed to help users save and later locate the position of their parked vehicle. The service is is offered through the PinPark mobile application and the PinPark website (together, the "service").

1.2 Guidance Only
The service is currently provided for general guidance and convenience purposes only. While PinPark aims to provide accurate location information, we do not guarantee the precision, availability, or reliability of any location data displayed within the application or website.

1.3 User Responsibility
Users acknowledge that they remain solely responsible for the safe parking, security, and retrieval of their vehicle. PinPark does not replace user awareness, signage, parking regulations, or physical landmarks, and should not be relied upon as the sole method of locating a vehicle.

1.4 Availability
We may update, modify, suspend, or discontinue any part of the service at any time, temporarily, or permenantly, without prior notice. We do not guarantee uninterrupted or error-free access to the service.

1.5 Eligibility
By using the service, users confirm that they are at least 16 years of age, or that they have permission from a parent or legal guardian to use the service. If the user is under 18 years of age, they acknowledge that their use of service is subject to applicable laws relating to minors.


2. Accounts and User Obligations

2.1 User Accounts
To access certain features of the PinPark app or website, users may be required to create an account. when creating an account, users agree to provide information that is accurate, current, and complete, and keep such information up to date where required.

PinPark reserves the right to suspend or terminate accounts that contain false, misleading or incomplete information.

2.2 Account security
Users are responsible for maintaining the confidentiality of their account credentials, including passwords and authentication details. The user agrees not to share their account credentials with any third party.

PinPark will not be liable for any loss or damage arising from unauthorised access to a user's account where such access results from the user's failure to safeguard their credentials.

2.3 Acceptable Use
Users agree to use the PinPark app and website only for lawful purposes and in a manner consistent with theirintended use.

They must not:

• Misuse or attempt to interfere with the operation, security, or integrity of the PinPark application or the PinPark website

• Use the service to transmit harmful, abusive, misleading, or unlawful content

• Attempt to access data, systems, or accounts that they are not authorised to access

• Use the service in a way that could damage, disable, or impair PinPark, or the experience of other users

2.4 User Responsibility
Users acknowledge that information provided through by the PinPark application (including, but not limited to: location data, directions, parking information, or reminders) is intended as guidance only.

Users remain solely responsible for:

• Complying with local laws, parking regulations, and signage

• Ensuring their vehicle is parked legally and safely

• Verifying any information before acting upon it

PinPark does not accept responsibility for fines, penalties, or losses incurred as a result of user actions.

2.5 User Conduct
Users agree to act respectfully and responsibly when using PinPark. Any behaviour deemed abusive, harmful, or disruptive to other users or to PinPark may result in account suspension or termination without notice.

2.6 Account Suspension and Termination
PinPark reserves the right to suspend or terminate user accounts temporarily or permenantly, at its sole discretion, where a user:

• Breaches these Terms and Conditions

• Engages in misuse or unlawful activity

• Poses a risk to the service, other users, or PinPark

Users may stop using the service at any time. Termination of an account does not affect any obligations or liabilities accured prior to termination.

2.7 Changes to Accounts
PinPark may modify, update, or remove account features at any time as part of ongoing development, maintenance, or improvement of the service. Where possible, reasonable notice will be provided.


3. Data & Privacy

3.1 Personal Data
PinPark may collect and process certain personal data in order to provide and improve its services. This may include, but is not limited to: email addresses, account details, device information, and location data where required for functionality.

Personal data is collected only where necessary, and is handled in accordance with applicable data protection laws.

3.2 Location Data

Location is processed only with user permission and only for the purpose of delivering relevant app functionality. Users may manage or disable location permissions through their device settings, though doing so may limit certain features.

All content, features, and functionality available through the PinPark mobile application and PinPark website, including but not limited to text, graphics, logos, icons, designs, layouts, software, and code (collectively, the "content") are owned by or lisenced to PinPark and are protected by intellectual property laws.

Nothing in these Terms and Conditions grants users any ownership rights in the content.

4.2 License to Use
PinPark grants users a limited, non-exclusive, non-transferrable, and revocable license to access and use the mobile application and website for personal, non-commercial purposes only, in accordance with these Terms and Conditions.

4.3 Restrictions
Users must not, without prior written permission from PinPark:

• Copy, reproduce, modify, distribute, or publicly display any part of the content

• Reverse engineer, decompile, or attempt to extract source code from the mobile application

• Use PinPark branding, logos, or trademarks without authorisation

• Use the content for commercial purposes

4.4 Trademarks
The name "PinPark", associated logos, branding, and visual elements are trademarks of PinPark or are used under license. Unauthorised use of these trademarks is prohibited.

4.5 User Content
Where users are permitted to submit content, users retain ownership of their content, but grant PinPark a non-exclusive, royalty-free license to use, display and process such content solely for the purpose of operating and improving the service.

4.6 Third-Party Content
The PinPark app and website may include content, services, or links provided by third parties. All third-party intellectual property remains the property of its respective owners, and use of such content is governed by the relevant third-party's terms and policies.


5. Limitation of Liability and Disclaimers

5.1 Service Provided "As Is"
The PinPark mobile application and PinPark website are provided on an "as is" and "as available" basis. While we aim to provide a reliable and useful service, we make no guarantees that the service will always be accurate, complete, up to date, or available without interruption.

5.2 No Warranty
To the fullest extent permitted by law, PinPark disclaims all warranties, express or implied, including but not limited to warranties of accuracy, reliability, fitness for a particular purpose, and non-infringement.

5.3 Location and Navigation Disclaimer
Any location information, directions, routes, distances, or parking-related data provided through the service are for general guidance only. Such information may be affected by factors outside our control, including GPS accuracy, device limitations, environmental conditions, or third-party data-sources.

Users are responsible for excercising their own judgement and complying with local laws, parking regulations, signage, and road conditions.

5.4 No Liability for Fines or Loss
PinPark shall not be liable for any parking fines, penalties, towing, vehicle damage, loss of property, or other losses incurred as a result of reliance on information provided by the service.

5.5 Limitation of Liability
To the maximum extent permitted by law, PinPark shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, or loss of use, arising out of or in connection with the use of the mobile application or website.

Where liability cannot be excluded under applicable law, PinPark's total liability shall be limited to the extent permitted by law.

5.6 Health and Safety
Users remain responsible for their own safety when using the service. PinPark should not be used in a manner that distracts from driving, walking safely, or complying with road safety rules.

5.7 Nothing in These Terms
Nothing in these Terms and Conditions shall exclude or limit liability for:

• Death or personal injury caused by negligence

• Fraud or fraudulent misrepresentation

• Any liability that cannot be excluded under applicable law


6. Changes to the Service and Terms

PinPark may update, modify, suspend, or discontinue any part of the mobile application at any time, including features, functionality, or availability. Such changes may be made for reasons including development, maintenance, improvement, security, or operational requirements.

Where reasonable possible, we will aim to provide a notice of significant changes, but we do not guarantee advance notice in all circumstances.

6.2 Updates and Improvements
The PinPark service is under ongoing development. Features may be added, removed, or adjusted over time, and user experience may change as improvements are introduced.

Continued use of the mobile application or website following updates constitues acceptance of those changes

6.3 Changes to These Terms
PinPark reserves the right to amend or update these Terms and Conditions at any time. Any changes will be posted on the PinPark website.

By continuing to use the app or website after changes to these Terms and Conditions are published, users agree to be bound by the updated Terms and Conditions.

6.4 Availability
PinPArk does not guarantee that the app or website will always be available of free from errors. Temporary interruptions may occur due to maintenance, technical issues, or circumstances beyond our control.


7. Governing Law and Jurisdiction

These Terms and Conditions are governed by and construed in accordance with the laws of England and Wales.

Any disputes arising out of or in connection with these Terms and Conditions, the PinPark mobile application, or the PinPArk website shall be subject to the exclusive jurisdiction of the courts of England and Wales.

The PinPark service is operated from the United Kingdom. Users accessing this service from outside the UK do so at their own initiative and are responsible for compliance with local laws where applicable.
